BP accused of lying to govt during Gulf oil spill

(AP) ? BP lied to the U.S. government and withheld information about the amount of oil spilling into the Gulf of Mexico after its well blew out in 2010, attorneys told a judge Monday.

But lawyers for the London-based oil giant denied those accusations and said there was no way to prepare for such a unique blowout a mile below the sea floor. Second-guessing the company's efforts to cap the well was "Monday morning quarterbacking at its worst," BP attorney Mike Brock said during opening statements of the second phase of a trial over the spill.

This part focuses on BP's response to the disaster and is designed to help U.S. District Judge Carl Barbier determine how much oil spewed into the Gulf.

The government's estimate is 70 million gallons more than what BP says spilled. Establishing how much oil leaked into the Gulf during BP's struggle to cap the well will help figure out the penalties the oil company must pay. Billions of dollars are at stake.

The first phase of the trial centered on what caused the blowout.

Brian Barr, an attorney for residents and businesses who claim they were hurt by the spill, said BP failed to prepare for a blowout and compounded the problem by misleading federal officials.

BP had a 600-page oil spill response plan that only included one page on "source control." It simply called for assembling a team of experts to devise a way to stop a blowout, Barr said.

"BP's plan was nothing more than a plan to plan," he said.

The April 20, 2010, blowout of BP's Macondo well 50 miles off the Louisiana coast triggered an explosion that killed 11 workers on the Deepwater Horizon drilling rig and spawned the nation's worst offshore oil spill. BP used a capping stack to seal the well on July 15, 2010, after other methods failed.

BP maintains its spill preparations complied with every government requirement and met industry standards. But the blowout presented unforeseen challenges, Brock said.

In May 2010, BP tried in vain to use the "top kill" method to stop the flow of oil by pumping mud and other material into the blowout preventer. Plaintiffs' lawyers claim BP knew the strategy was doomed to fail based on higher flow rate estimates that the company didn't share with federal officials at the time.

"Nevertheless, BP pressed ahead and falsely claimed that it was a slam dunk," said Brad Brian, an attorney for rig owner Transocean.

In videotaped testimony shown in court Monday, former Energy Secretary Steven Chu said BP didn't provide him with certain data that could have been relevant in evaluating the "top kill" procedure.

"If one knew earlier the amount of flow, things would have been different," Chu said.

A week after the spill started, high-ranking BP official Doug Suttles told Coast Guard Rear Adm. Mary Landry that the company estimated oil was flowing at a rate of 1,000 to 5,000 barrels per day. But the company's adversaries at the trial say BP's own internal documents and emails show an effort to conceal much higher estimates.

"BP's policy of not releasing the flow-rate information was enforced at the highest levels of the company," Brian said, pointing to an email that a BP employee sent to BP Exploration and Production CEO Andy Inglis and his assistant on May 15.

The employee, Mike Mason, warned them that they should be "very cautious" standing behind the lower estimate because his team's models showed estimates that were up to 20 times higher.

Mason said he was called in for a meeting the following day with Inglis' assistant, who suggested he shouldn't have put his warning in writing. When Mason asked what the problem was, the assistant replied, "It's the big number," Mason recalled in videotaped testimony.

The top kill was among several methods that didn't work. Other attempts, such as the Cofferdam and the "top hat," also failed. The terms were obscure industry jargon before the spill but became buzzwords as the company scrambled to find a way to plug the well.

BP insists it was properly prepared to respond to the disaster, but Barr argued the company could have capped the well much sooner if it hadn't ignored decades of warnings about the risks of a deep-water blowout.

"BP refused to spend any time or money preparing to stop a deep-water blowout at its source," he said.

BP used a capping stack to finally stop the gusher on July 15, 2010. Brock rejected the notion that BP could have stopped the spill much sooner if it had a pre-built capping stack on hand. Nobody in the industry had used such a device before, he added.

"It was a unique situation," he said. "It was a unique blowout."

Under the Clean Water Act, a polluter can be forced to pay a maximum of either $1,100 or $4,300 per barrel of spilled oil. The higher maximum applies if the company is found grossly negligent, as the government argues BP should be. But the penalties can be assessed at amounts lower than those caps. Congress passed a law dictating that 80 percent of the Clean Water Act penalties paid by BP must be divided among the Gulf states.

The Justice Department's experts estimate 4.2 million barrels, or 176 million gallons, spilled into the Gulf. BP has urged Barbier to use an estimate of 2.45 million barrels, or nearly 103 million gallons, in calculating any Clean Water Act fines. Both sides agree that 810,000 barrels, or 34 million gallons, was captured before it could pollute the Gulf.

Using the government's figures, a maximum penalty if the company is found negligent could total $18 billion. Using the company's figures, that maximum penalty would be around $10.5 billion.

In late July, BP reported a second quarter net profit of $2 billion as lower oil prices, higher taxes and a drop in income from its operations in Russia took their toll on the company. The company has already set aside more than $42 billion for the oil spill, including damage claims from residents and businesses.

Barbier has outlined a rigid schedule for attorneys to present their arguments and evidence over the next four weeks. A penalty phase for the trial has not been scheduled yet.

Osram to cut 900 jobs in North America

FRANKFURT (Reuters) - German lighting maker Osram Licht AG said it will shut down some of its lighting maintenance sites in the United States and Canada as it shifts its business away from traditional street lights to LED technology.

Osram said the restructuring at Osram Sylvania will affect around 900 staff. A spokesman declined to give staff numbers for Sylvania.

The company, which was spun off from Siemens in July, is slashing jobs and selling factories, having come under pressure to invest in LED technology to keep up with rivals.

Rangers force AL wild-card tiebreaker, beat Angels

ARLINGTON, Texas (AP) ? The Texas Rangers had to keep winning to keep playing. After seven wins in a row, they have to do it one more time to get into the playoffs.

Craig Gentry had a key two-run single, Geovany Soto had a tiebreaking RBI double and a solo homer, and the Rangers beat the Los Angeles Angels 6-2 Sunday to force a one-game tiebreaker for the second AL wild-card spot.

"They showed heart, fight, gut ? any other adjective you want to find," Rangers manager Ron Washington said.

The Rangers (91-71), who began September with the AL West lead before a 5-15 slide, added game No. 163 to the regular season. They will host Tampa Bay on Monday night in baseball's first wild-card tiebreaker since 2007. The winner plays two days later at wild-card leader Cleveland for a berth against Boston in the division series.

"You can't say enough. Just the fight, the character of this team," Gentry said. "From being about as low as we could possibly be and almost everybody probably counting us out, and to come home and play the way we have."

Rookie left-hander Martin Perez (10-5, 3.55 ERA) starts for Texas on Monday against Tampa Bay and lefty David Price (9-8).

About the same time Tampa Bay wrapped up its 7-6 win at Toronto to necessitate a victory by the Rangers, Gentry hit a two-run single in the fifth for a 2-1 lead.

Los Angeles quickly tied the game in the sixth against major league strikeout leader Yu Darvish, but the Rangers went ahead to stay in the bottom half on Soto's two-out double.

Adrian Beltre and Soto added solo homers in the eighth. It was Beltre's 30th and the ninth for Soto, who has become the primary catcher for Darvish.

Texas has been in the playoffs the past three seasons, last year losing at home to Baltimore with Darvish on the mound in the AL's first one-and-done wild-card game.

With a chance to get back in the postseason for the fourth year in a row, they will get back Nelson Cruz. The All-Star slugger on Sunday completed his 50-game suspension that followed Major League Baseball's investigation of the Biogenesis anti-aging clinic, which was accused of distributing banned performance-enhancing drugs.

General manager Jon Daniels said Cruz, who has been playing in the instructional league in Arizona the past two weeks, will be activated for Monday's game. The Rangers were 29-21 without Cruz, who has 27 homers and 76 RBIs this season.

"I'll have a chance tomorrow to be with me teammates and do the thing I love the most, play baseball," said Cruz, who went 9 for 27 with five doubles, a homer and nine RBIs in eight games in Arizona. "The guys are excited. I'm excited."

Asked whether he expected to play Monday, Cruz responded, "I think so."

The Angels (78-84) finished with a losing record for only the second time in 10 seasons after being swept in a four-game series at Texas for the first time since June 1978.

"You have to tip your cap to those guys. They played well and stayed alive," Angels manager Mike Scioscia said. "Our guys played as well as they could. It would have been nice to come in here and get some wins. .. I'm disappointed, but there's nothing to be ashamed about the way we went after them. Those guys brought their game up a notch, and we're going home."

Neal Cotts (8-3) replaced Darvish in the sixth and allowed the tying hit, but struck out Howie Kendrick for the inning-ending out with runners on first and third.

Robbie Ross, Tanner Scheppers and Joe Nathan each pitched a scoreless inning after that.

When the Rangers started their game, Tampa Bay already led 7-0 at Toronto. Then Mike Trout homered to put the Angels up 1-0.

Darvish struck out eight in 5 2-3 innings. But for the sixth time this season, and second game in a row, Darvish immediately gave up the lead a half-inning after the Rangers went ahead.

The right-hander from Japan finished with a majors-leading 277 strikeouts, the most since Randy Johnson had 290 for Arizona in 2004. The last AL pitcher with more was Pedro Martinez with 284 for Boston in 2000.

Darvish had retired 11 in a row after a one-out walk in the second, and a mound visit from Washington, pitching coach Mike Maddux, a trainer and Darvish's interpreter to check on him.

A.J. Pierzynski had a leadoff double in the fifth and Soto walked before an errant pickoff throw by Jason Vargas (9-8) moved both of them up a base. They scored on the single up the middle by Gentry, the No. 8 hitter who is 17 for 36 his last 10 games.

There was a reverse double play in the Angels sixth ? J.B. Shuck hit a grounder to second baseman Ian Kinsler, who ran back Andrew Romine before throwing to first baseman Mitch Moreland, who had to make a quick throw to shortstop Elvis Andrus to tag out Romine. But Darvish then gave up a single to Erick Aybar and walked Trout on four pitches.

Cotts, the left-hander whose 1.13 ERA is the lowest ever for a Texas reliever, gave up an tying RBI single to Josh Hamilton, who finished with a 14-game hitting streak ? his longest in his Angels debut after the previous five years with the Rangers.

"It is disappointing," Hamilton said. "They had something to play for, and we wanted to try to help them stumble."

Hollywood copyright cartel?s plot to indoctrinate California kindergartens

Sharing is the essence of digital creativity, but its enemies want to brainwash grade-schoolers with their commercial interests

In kindergarten, we teach children to share. By second grade ? if people who bring you songs and pixie dust have their way ? we?ll amend that in a major way.

Hollywood and the recording industry (aka the Copyright Cartel) are leading the charge to create grade school lessons that ? at least, in their draft form, as published by Wired ? have a no-compromise message: if someone else created it, you need permission to use it.

Sounds wonderful, until you think about how creativity actually works. And never mind that the law, already tipped in favor of copyright holders, doesn?t hold such an absolutist position.

It?s no surprise to learn that America?s biggest internet service providers ? let?s call them the Telecom Cartel, since that?s what they?ve become ? are part of this propaganda scheme. It?s sad to learn, however, that the California School Library Association has climbed aboard; the organization helped produce the lessons that, thankfully, are still only in draft form. But they are likely to reach California classrooms later this school year and, presumably, other parts of the nation later on.

Wired obtained some of the draft lesson plans. They?re amazing (and not in a complimentary way). The lesson aimed at second graders (pdf), for example, winds up this way:

We are all creators at some level. We hope others will respect our work and follow what we decide to allow with our photos, art, movies, etc. And we ?play fair? with their work too. We are careful to acknowledge the work of authors and creators and respect their ownership. We recognize that it?s hard work to produce something, and we want to get paid for our work.

We?re definitely all becoming creators, and we do want others to respect our work. But in the real world, and under the law, we can?t make all the decisions about what uses we allow of that work. There?s a concept called ?fair use? ? deliberately ignored in the lesson, on the absurd basis that kids can?t understand it ? that explicitly allows others to make use of our work in ways we don?t like, or anticipate. Without fair use, creative works would be next to impossible, because we all build on the work of those who came before us.

Needless to say, this lesson and others made public ? including grades one (pdf), five (pdf), and six (pdf) ? have sparked a bit of an uproar outside the cartel?s orbit. As the Electronic Frontier Foundation?s Mitch Stoltz told Wired:

[The material] suggests, falsely, that ideas are property and that building on others? ideas always requires permission. The overriding message of this curriculum is that students? time should be consumed not in creating but in worrying about their impact on corporate profits.

What should schools actually be teaching? Happily, there are alternatives honoring copyright, which is important, but that also honor tradition, law and the greater culture.

Creative Commons? Jane Park has compiled an excellent listing of resources that educators can use to teach about copyright. I?m especially partial to the EFF?s Teaching Copyright, which I?ve recommended to students of all ages, including some college students.

The California School Library Association should never have let itself become a handmaiden to commercial Hollywood. Perhaps, its leaders will realize that they are undermining the crucial role libraries have played in our society when they assist the copyright absolutists? agenda ? because if libraries were invented today, the cartel would declare them to be both illegal and immoral.

I take some solace in a quote of the association?s vice president, Glenn Warren, in the Wired story. Confronted with the inaccuracy and imbalance of the lessons, he acknowledged:

We?ve got some editing to do.

In case you missed it, the U.S. Fourth Circuit Court of Appeals in Richmond recently overturned a lower court decision in a closely watched lawsuit involving First Amendment protections on social media?(Bland v. Roberts?12-1671).

The suit centered on two state employees who were fired for clicking ?Like? on Facebook. The appeals court struck down a circuit court judge who ruled that such social media activity is not protected free speech under the First Amendment.?

This is a significant court decision?because many people may take online free speech rights for granted, particularly with the proliferation of social media. However, uniform legal standards are still in dispute and hotly debated nationwide.

Insufficient Speech?

In the lower court ruling, federal district Judge Raymond A. Jackson of Newport News, Virginia, dismissed a lawsuit by two deputy sheriffs who asserted they were unlawfully fired for ?Liking? the Facebook page of the sheriff?s political adversary.

Facebook stated in its amicus brief:??If Carter [deputy sheriff] had stood on a street corner and announced, `I like Jim Adams [sheriff's opponent) for Hampton sheriff,' there would be no dispute that his statement was constitutionally protected speech. Carter made that very statement; the fact that he did it online, with a click of a computer's mouse, does not deprive Carter's speech of constitutional protection.?

However, the judge saw it differently.

In tossing out the case, Judge Jackson wrote: ?Merely ?liking? a page on Facebook is insufficient speech to merit Constitutional protection.?

The decision, about a year ago, set off alarm bells for advocates of free speech and online privacy. It raised the question of whether public employees can legally be terminated for simply ?Liking? something on social media even though their employer may find the content distasteful or simply disagree with it.

In his controversial decision, Judge Jackson held that such firings were legally justified.

But the appeals court disagreed, ruling?that clicking Facebook?s thumbs-up ?Like? icon ?is the Internet equivalent of displaying a political sign in one?s front yard, which the Supreme Court has held is substantive speech.?

The court added, ?On the most basic level, clicking on the ?like? button literally causes to be published the statement that the User ?likes? something, which is itself a substantive statement.?

While this ruling is good news, we should nonetheless be mindful that free speech online presents a plethora of novel legal issues in today?s fast evolving digital age.

Therefore, as traditional legal theory expands to address online free speech issues we should remain vigilant and cognizant of how our constitutional rights are applied on social media.

Bottom line: the judicial branch must continue to safeguard our cherished First Amendment freedoms whether online or off.

The suit centered on two state employees who were fired for clicking ?Like? on Facebook. The appeals court struck down a circuit court judge who ruled that such social media activity is not protected free speech under the First Amendment.?

This is a significant court decision?because many people may take online free speech rights for granted, particularly with the proliferation of social media. However, uniform legal standards are still in dispute and hotly debated nationwide.

Insufficient Speech?

In the lower court ruling, federal district Judge Raymond A. Jackson of Newport News, Virginia, dismissed a lawsuit by two deputy sheriffs who asserted they were unlawfully fired for ?Liking? the Facebook page of the sheriff?s political adversary.

Facebook stated in its amicus brief:??If Carter [deputy sheriff] had stood on a street corner and announced, `I like Jim Adams [sheriff's opponent) for Hampton sheriff,' there would be no dispute that his statement was constitutionally protected speech. Carter made that very statement; the fact that he did it online, with a click of a computer's mouse, does not deprive Carter's speech of constitutional protection.?

However, the judge saw it differently.

In tossing out the case, Judge Jackson wrote: ?Merely ?liking? a page on Facebook is insufficient speech to merit Constitutional protection.?

The decision, about a year ago, set off alarm bells for advocates of free speech and online privacy. It raised the question of whether public employees can legally be terminated for simply ?Liking? something on social media even though their employer may find the content distasteful or simply disagree with it.

In his controversial decision, Judge Jackson held that such firings were legally justified.

But the appeals court disagreed, ruling?that clicking Facebook?s thumbs-up ?Like? icon ?is the Internet equivalent of displaying a political sign in one?s front yard, which the Supreme Court has held is substantive speech.?

The court added, ?On the most basic level, clicking on the ?like? button literally causes to be published the statement that the User ?likes? something, which is itself a substantive statement.?

While this ruling is good news, we should nonetheless be mindful that free speech online presents a plethora of novel legal issues in today?s fast evolving digital age.

Therefore, as traditional legal theory expands to address online free speech issues we should remain vigilant and cognizant of how our constitutional rights are applied on social media.

Bottom line: the judicial branch must continue to safeguard our cherished First Amendment freedoms whether online or off.

China people-trafficking raid saves 92 babies and two women

Police in China have rescued 92 children and two women, according to Chinese state media. They were kidnapped to be sold on.

It?s one of the biggest people-trafficking busts in years, with the police making 301 arrests. A six-month long investigation led to a coordinated swoop on several locations across 11 provinces.

China?s strictly enforced one-child policy has led to a sharp rise in preference for boys in rural areas, leading to the trafficking of women and children in recent years.

The women are handed over to men in remote areas, who can?t marry due to a sex imbalance as a result of the one-child policy.

China claims a crackdown on such practices resulted in the rescue of more than 13,000 abducted children and 23,000 women over the past two years or so.

US Senate approves stopgap budget bill

Washington (AFP) - Following days of divisive debate, the US Senate voted Friday to advance a temporary budget, putting it on track for likely passage as Congress struggles to avoid a government shutdown.

The chamber voted 79-19 to end debate on the stopgap spending measure, setting up a vote within coming minutes aimed at stripping out langauge in the bill that would have defunded President Barack Obama's health care law.

A majority of Republicans joined a united Democratic caucus in voting yes for the measure, which required a three-fifths super-majority to overcome blocking tactics.

Democratic leader Harry Reid will now strip out the "Obamacare" defunding measure, a move that requires merely a simple majority in the 100-member chamber.

Should the bill pass as expected, also with a simple majority, the Senate will immediately send the legislation to the House of Representatives for consideration.

House Speaker John Boehner said Thursday that the Republican-led House is unlikely to pass a stripped down budget bill, suggesting his caucus will seek to insert some conservative sweeteners in the legislation and send it back to the Senate.

Such a move would push the US government perilously close to the end of the current fiscal year, September 30. If no funding bill is in place by Tuesday, October 1, many government agencies are mandated to start shutting their doors.

Spending $2.1 million on a new home may seem like a lot for the average American and even for Miami Beach ??the median home value is currently $310,400 ? but for someone slated to earn $28 million in 2013, it?s a drop in the bucket, and slightly surprising.

Syrian chemical arms inspections could begin soon

THE HAGUE, Netherlands (AP) ? The inspectors responsible for tracking down Syria's chemical arms stockpile and verifying its destruction plan to start in Syria by Tuesday. They will face their tightest deadlines ever and work right in the heart of a war zone, according to a draft decision obtained Friday by The Associated Press.

The decision is the key to any U.N. resolution on Syria's chemical weapons program.

The five permanent members of the deeply divided U.N. Security Council reached agreement Thursday on a resolution to eliminate Syria's chemical weapons. A vote depends on how soon the Organization for the Prohibition of Chemical Weapons, which is meeting later Friday at its headquarters in The Hague, can adopt its plan for securing and destroying Syria's stockpile.

U.N. diplomats say the Security Council hopes to meet Friday evening to vote on the resolution, but that depends on events in The Hague.

The draft agreed upon by Russia, China, the United States, France and Britain includes two legally binding demands ? that Syria abandons its chemical stockpile and allows unfettered access to the chemical weapons experts.

If Syria fails to comply, the draft says the Security Council would need to adopt a second resolution to impose possible military and other actions on Damascus under Chapter Seven of the U.N. charter.

Issam Khalil, a member of Syrian President Bashar Assad's ruling Baath party, portrayed the deal as an American diplomatic failure.

"The resolution does not include threats or even possibilities of misinterpretations in a way that would let America and its allies to take advantage of it as they did in Iraq," Khalil said in Damascus.

Nonetheless, after 2 ? years of paralysis, the agreement represents a breakthrough for the Security Council and rare unity between Russia, which supports Assad's government, and the United States, which backs the opposition.

The diplomatic push to find some agreement on Syria was triggered by an Aug. 21 poison gas attack that killed hundreds of civilians in a Damascus suburb and President Barack Obama's subsequent threat to use military force.

The U.S. and Russia agree that Syria has roughly 1,000 metric tons of chemical weapons agents and precursors, including blister agents such as sulfur and mustard gas and nerve agents like sarin.

A group of U.N. inspectors already on the ground in Syria investigating the alleged use of chemical weapons said Friday they are probing a total of seven sites of suspected attacks, including the Damascus suburb where hundreds were killed last month. That number was raised from three sites previously.

Even as diplomatic headway was being made, Syria was wracked by more violence Friday: activists said a car bomb near a mosque killed at least 30 people.

The Britain-based Syrian Observatory for Human Rights, an activist group that monitors the crisis, said the explosion struck as worshippers at the al-Sahel mosque in Rankous were leaving after Friday prayers.

Residents of Rankous, about 40 kilometers (25 miles) north of Damascus, later held funerals for some of the bombing victims. At one funeral, several rockets fired by government troops fell nearby, wounding some of the mourners, activist Mohammed Saeed said.

Car bombs, shelling and airstrikes have become common in Syria's civil war, which has killed more than 100,000 people and driven another 7 million ? around a third of the country's pre-war population ? from their homes since March 2011. The conflict has heavily damaged cities and Syria's social fabric as it has taken on increasingly dark sectarian overtones, pitting a primarily Sunni Muslim rebel movement against a regime dominated by Assad's Alawite sect.

The proposal being discussed Friday by the OPCW would allow inspectors into any site suspected of chemical weapons involvement even if Syria's government did not identify the location. That gives the inspectors unusually broad authority.

The draft calls for the organization's secretariat to start inspections "as soon as possible and no later than" Tuesday and sets a target of destroying all of Syria's chemical weapons and equipment by the first half of 2014.

It calls on Syria to "cooperate fully with all aspects of the implementation of this decision" and let the inspectors examine any location they choose.

Once the plan is approved, it gives Damascus a week to give detailed information on its arsenal, including the name and quantity of all chemicals in its stockpile; the type and quantity of munitions that can be used to fire chemical weapons and the location of weapons, storage facilities and production facilities. All chemical weapons production and mixing equipment should be destroyed no later than Nov. 1.

In an indication of the enormity of the task ahead, the OPCW also appealed for donations to fund the disarmament, saying it will have to hire new weapons inspectors and chemical experts.

The diplomatic turning point came when U.S. Secretary of State John Kerry said Assad could avert U.S. military action by turning over "every single bit of his chemical weapons" to international control within a week. Russia quickly agreed.

Kerry and Russian Foreign Minister Sergey Lavrov signed a deal on Sept. 13 to put Syria's chemical weapons under international control for later destruction. Assad's government accepted the deal and quickly signed up to Chemical Weapons Convention that is policed by the Hague-based OPCW.

Meanwhile, a group of international war crimes experts is calling for the creation of a war crimes court in Damascus to try top-ranking Syrian politicians, soldiers or rebels when the country's civil war ends.

Professor Michael Scharf of Case Western Reserve University told The Associated Press that draft statutes for such a court have been quietly under development for nearly two years.

Scharf said the group is going public now to push the issue of accountability for war crimes in Syria in hopes that will deter combatants from committing further atrocities.

Syria is not a party to the International Criminal Court ? the permanent war crimes tribunal in The Hague, Netherlands ? so the ICC does not have jurisdiction over war crimes there.

In Geneva, the U.N.'s top human rights body on Friday condemned what it called "systematic and widespread" rights violations by Syrian government forces.

The Human Rights Council, meeting in Geneva, voted 40-1 with six abstentions to approve a resolution condemning "continued gross, systematic and widespread violations of human rights ... by the Syrian authorities and affiliated militias" and "any human rights abuses" by opposition groups.

The lawsuit, assisted by the National Rifle Association, who has brought a federal lawsuit (Bauer v. Harris) seeking similar relief on Second Amendment grounds, seeks to stop DOJ from continuing to stick law abiding gun owners with the bill for funding its general law enforcement projects through the DROS fee.

Abandoned gold bars baffle German police

(AP) ? Attention all passengers: could the person who left a stash of gold bars and a pile of banknotes in the luggage deposit at Cologne's main railway station kindly contact German police?

That was the appeal that police in the western German city issued Friday for information to track down the owner of the several kilos (pounds) of gold and a six-figure sum of euros in cash.

The stash was found in April in a luggage locker at the station, a major European transport hub. Police said they're going public after being unable to link the haul to any crime and hearing nothing from any legitimate owner.

Whoever the owner is shouldn't leave it too much longer. Police say that if nobody comes forward, the stash will be sold.

Spacecraft delivers 3 to orbiting space station

MOSCOW (AP) ? A Soyuz capsule carrying three astronauts successfully docked with the International Space Station early Thursday, bringing the size of the crew at the orbiting outpost to six. The new crew's six-month mission will include a spacewalk with the Olympic torch.

American Michael Hopkins and Russians Oleg Kotov and Sergei Ryazansky traveled six hours in the capsule from the Russian-leased launch pad in Kazakhstan before linking up with the space station's Russian Poisk research module at 6.45 a.m. Moscow time (0245GMT).

Kotov is the most experienced member of the crew with two previous six-month missions in space under his belt, while Hopkins and Ryazansky are both on their first missions.

The incoming crew entered the station nearly two hours after the docking, where they were welcomed by Russia's Fyodor Yurchikhin, NASA's Karen Nyberg and Italy's Luca Parmitano, who have been on the orbiting lab since May and will be returning to Earth in November.

Kotov and Ryazansky will have the honor of taking the Olympic torch into open space in November as part of the relay of the Olympic flame ahead of the Winter Games being held in Russia's Sochi in February. The torch will not be lit however, because of safety concerns. It will only arrive at the station in November with the next mission.

Shortly after entering the station, Hopkins, Kotov and Ryazansky had a chat via a video-link with their families back at the Baikonur launch pad where they had seen them off more than eight hours before.

Radiant but visibly tired, the astronauts were yawning as they were talking to their families. They had been up for about 20 hours.

Hopkins' mother described the launch as a "heart-stopping experience."

"It was a pretty good ride, mom. It was a lot of fun," Hopkins replied in the live broadcast on NASA TV.

Iran, U.S., other powers open nuclear talks; Kerry aims to keep up pressure

UNITED NATIONS (Reuters) - Iran's new government began its first talks on its nuclear program with the United States and five other world powers on Thursday, with the Iranian foreign minister taking a seat next to U.S. Secretary of State John Kerry in a rare high-level contact between the two long-estranged nations.

Foreign Minister Mohammad Javad Zarif went into talks on the sidelines of the U.N. General Assembly with Kerry as well as counterparts from Britain, France, Russia, China and Germany at a session aimed at jump-starting efforts to resolve a decade-long standoff over Iran's nuclear ambitions.

It was a very uncommon encounter between top officials of the United States and Iran, which have been estranged since Iran's 1979 Islamic Revolution that toppled the U.S.-backed Shah. Thursday's meeting was the first between a U.S. secretary of state and an Iranian foreign minister since a brief encounter in May 2007.

Ahead of the talks, Kerry said he looked forward to a "good meeting" - the first involving the newly elected Iranian government of centrist President Hassan Rouhani - but would not specify what Iran should do to show a genuine desire to address concerns about its nuclear program.

A senior U.S. State Department official, speaking on condition of anonymity, said the United States did not expect any issues to be resolved at the meeting, but added: "We are hopeful that we can continue to chart a path forward.

"We hope that this new Iranian government will show that it is prepared to engage substantively to address these long- standing concerns and we will see today and in months ahead whether they will follow words with action," the official said.

Zarif is a U.S.-educated diplomat appointed by Rouhani to head negotiations on the nuclear issue with the five permanent members of the U.N. Security Council and Germany, known as the P5+1.

A moderate cleric, Rouhani has stepped up efforts to moderate Iran's image abroad during his visit to New York this week. He has said that Iran would never develop nuclear weapons - despite Western suspicions that it is seeking to do so - and called for a nuclear deal in three to six months. Iran says its nuclear program is for peaceful energy purposes only.

Even without making any real concessions so far, Rouhani has offered a softer, more reasonable tone than his stridently anti-U.S. predecessor, Mahmoud Ahmadinejad.

Addressing a U.N. meeting on nuclear disarmament on Thursday, Rouhani said: "No nation should possess nuclear weapons, since there are no right hands for these wrong weapons."

But Rouhani also seized the opportunity to take a swipe at Iran's arch-foe Israel, which has accused him of trying to fool the world and buy time to continue its nuclear advances.

Rouhani said Israel, widely assumed to be the Middle East's only nuclear-armed state, was the reason for the failure of international efforts to establish the region as a nuclear weapons-free zone.

U.S.-CHINA MEETING

Just hours before the start of the talks, Kerry secured agreement from his Chinese counterpart calling for Iran to respond positively to existing nuclear proposals by the six world powers, U.S. officials said.

The U.S. comments suggested that President Barack Obama's administration intends to deal cautiously with Rouhani's overtures, avoiding any major concessions unless Iran takes concrete steps to show it is serious about curbing its nuclear ambitions. Rouhani is seeking an easing of crippling international sanctions.

"Both the U.S. and China believe that Iran should cooperate with the P5+1 and should respond positively to the proposals that are on the table," a U.S. official said.

The six powers said in February that they want Iran to stop enrichment of uranium to 20 percent, ship out some stockpiles and shutter a facility where such enrichment work is done. In return, they offered relief on international sanctions on Iran's petrochemicals and trade in gold and other precious metals.

Rouhani's gestures since taking office in August have raised hopes for a thaw in relations between Washington and Tehran after years of estrangement and for a resolution of the dispute on Iran's nuclear program.

But signaling some of the obstacles that could hamper any new diplomacy, Iran on Thursday sharply criticized the U.N. nuclear watchdog over "baseless allegations" about its atomic activity.

It was an apparent reference to the International Atomic Energy Agency's concerns, spelled out in a series of quarterly reports, about what it calls the possible military dimensions to Iranian nuclear activities.

NO HANDSHAKE

Obama on Tuesday cautiously embraced Rouhani's gestures as the basis for a possible nuclear deal and challenged him to demonstrate his sincerity.

The failure to orchestrate a handshake between the two leaders, apparently due to Rouhani's concerns about a backlash from hardliners at home and possibly Obama's concerns about the possibility of a failed overture, underscored how hard it will be to make diplomatic progress.

Asked what he needed to hear from the Iranians to show they were serious about addressing those concerns, Kerry told reporters: "I'll let you know after they've been serious."

A U.S. official said the U.S.-China meeting discussed "elements of the diplomatic track, as well as the sanctions track." Kerry also met with diplomats from Libya and Pakistan on Thursday.

European Union foreign policy chief Catherine Ashton, who is hosting the P5+1 meeting, met Rouhani earlier on Thursday.

Abbas Araqchi, the Iranian deputy foreign minister, told Press TV, Iran's state-owned English-language broadcaster that it was certain there was "a new will emerging both in Iran and among the P5+1 states to successfully conclude the new round of talks with a new approach."

Iranians are hoping to see some tangible steps taken by the Western powers - namely relief from the painful U.S., European Union and U.N. sanctions for refusing to suspend its uranium enrichment program.

Iranian oil exports have fallen by around 60 percent in the past two years as the EU stopped purchases completely and most Asian buyers drastically cut imports because of sanctions. Iran is now earning around $100 million from oil sales a day as opposed to $250 million two years ago.

SAN FRANCISCO ? A federal judge on Thursday refused to dismiss most of a lawsuit against Google over allegations the company improperly scanned the content of customers' emails in order to place ads.?

U.S. District Judge Lucy Koh in San Jose, Calif., ruled that the proposed class action lawsuit against Google can proceed. She rejected Google's argument that its users had consented to having their email read for the purposes of targeted advertising.?

"We're disappointed in this decision and are considering our options," Google spokesman Matt Kallman said in an email.?

Litigation brought by nine plaintiffs, some Gmail users, some not, was consolidated before Koh earlier this year. The plaintiffs maintain Google violated several laws, including federal anti-wiretapping statutes by systematically crossing the "creepy line" to read private email messages in order to profit, according to court documents.?

Google moved to dismiss the lawsuit, arguing in part that the plaintiffs had consented to the scanning when they agreed to Google's terms of service. Koh disagreed.?

"Nothing in the policies suggests that Google intercepts email communication in transit between users, and in fact, the policies obscure Google's intent to engage in such interceptions," the judge wrote.?

Koh did dismiss two claims brought by the plaintiffs but gave them an opportunity to refile them with additional facts.?
