He goes big where it counts, like depicting David?s sickening injuries, but he also puts in small touches that are no less moving, like the slight downward slant projecting sorrow in the ghosts? pupil-less eyes.

Jeff Katz: California Adoption -- Why Is It So Hard to Adopt From ...

That was a recent Facebook post by James Higgins, child advocate, adoptive father of two young children, and stay-at-home dad, or as he describes it, "The President and CEO of Chocolaty Niblets, Inc."

Clearly, the man enjoys fatherhood.

When James and his wife Stephanie, an attorney and bank compliance officer, decided in early 2009 to adopt a daughter through foster care, he assumed it would be pretty easy. After all, there are 68,000 children in California waiting to be adopted. Over a quarter of these children are African American, four times their proportion of the general population. James worked at a San Diego nonprofit that trains Court Appointed Special Advocates (CASAs) to protect the best interests of foster children. James assumed that as a two-parent black family, a child advocate and an attorney, a couple who had already became parents to a son through a private adoption, California's child welfare system would welcome them with open arms.

James was wrong.

The entire process, from application to finalization took almost two years. The problem was not the private agency they worked with. James raves about how responsive they were. For James and Stephanie, their experience with California's public agencies is where the adoption process became a story of frustration, unreturned calls, and irrational bureaucracy. It took over a year before they were even considered for a waiting child. Their struggle presents a case study in the obstacles that face anyone trying to adopt a child from a public agency in California:

California's budget crisis -- States are required to provide emergency services for abused or neglected children. They are federally mandated to provide family reunification services when those children are removed from their families and placed in foster care. So when California reduced funding for county child welfare services by $80 million, adoption services were the first to go. Phone calls to county adoption offices that used to take weeks to be returned were not returned at all.

Difficulty in adopting across county lines -- California has a state-supervised, and county-administered approach to foster care. Each one of California's 58 counties is largely self-contained. The same dynamic that makes interstate adoption rare also serves to discourage adoptions across county lines. In a county-administered system, each county is only interested in finding families for their kids. In this system, it is rational behavior for San Diego County to keep a family (such as James') waiting for two years rather than adopting a child from neighboring Orange County tomorrow.

The legal orphan conundrum -- California is one of those states where courts are uncomfortable freeing children for adoption unless they are confident that adoption is almost a certainty. Courts appear loath to create "legal orphans." Of course, most people adopting children are loath to adopt a child who is not legally free. Few parents are willing to take the risk, however remote, of giving their heart to a child, only to have a court give that child back to the birth parents. Imagine watching your daughter, a year after entering your family, returning to the the people who hurt her in the first place.

California is not actively recruiting families for children -- Go to the website that lists California's children in foster care who are available for adoption.There you will learn that "Currently there are over 68,000 children in foster care in California who need permanent, loving adoptive families." Click on "Find a Child" and you will discover that there are only 218 children in the entire state of California currently listed on the state's directory of waiting children. 218.

I'll do the math for you. 68,000 waiting children divided by 218 children listed means that for every child listed in the directory, there are 312 children "who need permanent, loving adoptive families" and are not listed.

How would James and his wife even find out about any of these children who are not listed?

But James is a ferocious advocate. He made call after call, argued, cajoled, and held the system accountable. In January of this year, James and Stephanie finalized the adoption of a beautiful little girl that James describes as "a pure blessing to our family." The only reason James and Stephanie were able to adopt is that they went through a private agency, one with a state license and a handful of offices throughout California. Had they gone to their county program they would have been limited to San Diego County and still be waiting.

Many parents trying to adopt children from foster care wait far longer than James and Stephanie did. In the greater scheme of things, the two years it took is not a long time.

Unless, of course, you are a hurt child waiting for a loving family.

Foreclosure Sales Down; Mortgage Rates Dip Again

Sales of homes in some stage of foreclosure declined in the first quarter from a year earlier, but they still accounted for 28 percent of all home sales a share nearly six times higher than what it would be in a healthy housing market.

Meanwhile, average rates on 30-year mortgages inched down this week to 4.60 percent, the lowest point of the year, Freddie Mac said Thursday.

Foreclosure sales, which include homes purchased after they received a notice of default or were repossessed by lenders, hit the highest share of overall sales in a year during the first quarter, foreclosure listing firm RealtyTrac Inc. said.

"It's an astronomically high number," said Rick Sharga, a senior vice president at RealtyTrac. "In a normal market, you're looking at the percentage of homes sold in foreclosure to be below 5 percent."

The pace at which homes are entering the foreclosure process has slowed in recent months amid bank and court delays. But distressed properties remain a fixture of a housing market still searching for a sustained recovery. The properties, often in need of repair, typically sell at a discount, weakening prices for other types of homes.

As a slice of all home purchases, foreclosure sales peaked two years ago at 37.4 percent. In the first quarter, they rose from 27 percent in prior quarter, but fell from 29 percent a year earlier, according to RealtyTrac.

Sales of foreclosure properties didn't fare much better than other types of homes, however.

In all, 158,434 homes in some stage of foreclosure were sold in the first quarter, down 16 percent from the last three months of 2010 and down 36 percent versus a year ago. Sales of all other types of homes also declined sharply, according to RealtyTrac's figures, which differ from other home-sales estimates.

While the number of bank-owned properties sold declined, they grew as a share of all home sales. Bank-owned homes accounted for nearly 19 percent of all sales, up from 17 percent in the fourth quarter and up from 18 percent a year ago, the firm said.

That's not good news for the housing market.

RealtyTrac estimates there are 872,000 homes that have been repossessed by lenders, but have yet to be sold. At the first-quarter's sales pace, it will take three years to clear the inventory of 1.9 million properties already in some stage of foreclosure.

For bank-owned properties alone, that amounts to a 2-year supply.

"Clearly, the housing market is not out of the woods," Sharga said.

Homebuyers who purchased a bank-owned home in the first quarter saved an average of 35 percent versus the average price of other types of homes, RealtyTrac said.

That discount is unchanged from the previous quarter, but up from an average of 33 percent a year ago.

Foreclosure Discounts Shrink

Buyers who snapped up other homes in the foreclosure process, including short sales, got an average discount of 9 percent, the firm said. That's down from an average of 13 percent in the fourth quarter and an average of 14 percent a year ago. In a short sale, the seller and their lender agree to sell the home for less than what is owned on the mortgage.

The biggest foreclosure discounts were to be had in Ohio, where foreclosure properties sold for an average of 41 percent less than other types of homes, RealtyTrac said.

The average sales price of a foreclosure property was $168,321, down 1.9 percent from the fourth quarter and 1.5 percent from the first quarter last year, the firm said.

At a state level, Nevada led the nation with foreclosure sales accounting for 53 percent of all home sales, RealtyTrac said. That was down from 59 percent the year before.

The state has the highest foreclosure rate in the nation and an inventory of nearly 28,000 bank-owned properties on bank's books. Buyers scooping up foreclosure properties there in the first quarter got an average discount of nearly 18 percent compared to the average sales price of other types of homes, RealtyTrac said.

In California, foreclosure sales accounted for 45 percent of all home sales in the first quarter, down from nearly 48 percent a year earlier. The average foreclosure property sold for nearly 34 percent less than the average sales price of homes not in foreclosure.

In Arizona, foreclosure sales represented 45 percent of all home sales for the quarter, down from 47 percent a year earlier.

Several other states had foreclosure sales that accounted for at least one quarter of all home sales in the first quarter: Idaho, Florida, Michigan, Oregon, Virginia, Colorado, Illinois, Georgia and Ohio.
